Family Appeals Noise Ruling on Heat Pump to Environment Court
A Christchurch family is challenging a noise ruling regarding their heat pump in the Environment Court. The issue arose after local authorities issued an abatement notice, requiring the family to turn off the external unit of their heat pump during nighttime hours, specifically between 10pm and 7am. This decision followed complaints from neighbours about the noise since 2023.
Patrick Smith, the family’s head, has expressed concern over the impact of the noise restrictions on his family’s wellbeing. In his appeal to the court, he outlined the difficulties his family faces due to the ban. “My children are waking several times in the night because they are cold; my wife and I are having to get up, put the children back to bed and resettle them each time,” he stated, highlighting the emotional toll involved.
The noise complaints from neighbours prompted the council to take action, leading to the issuance of the abatement notice. Smith argues that the heat pump is essential for maintaining a comfortable living environment, especially during cold nights. His appeal emphasizes the need for a balance between community concerns and a family’s right to a warm home.
The Environment Court will review the case, considering both the complaints from residents and the Smith family’s request for a reconsideration of the noise restrictions. As the proceedings unfold, the outcome may set a precedent for similar disputes involving residential noise and the use of heat pumps in urban areas.
