Auckland Landlord Pays Tenant $58,000 to End Lease, Seeks Refund

A landlord in Auckland has paid her tenant, Giles Ellis, a substantial sum of $58,000 to terminate his lease early. This decision, however, has led to a dispute as the landlord later requested that the Tenancy Tribunal mandate a partial repayment, citing a change of heart regarding the agreement.
The apartment in question is located in the prestigious Shangri-La complex and is owned by Sustainable Properties (Anderson), with Heather Anderson identified as the sole director of the company. According to a recent decision from the tribunal, the landlord initially agreed to the early termination of the fixed-term tenancy to facilitate better marketing of the property for sale.
Anderson expressed regret about the amount paid and subsequently sought to reclaim $41,000 of the total sum. The tribunal noted that she believed $17,000 would have been a more appropriate figure for ending the tenancy early.
The case highlights the complexities surrounding rental agreements and the financial implications of early terminations. It raises questions about the rights of landlords and tenants when negotiations do not go as planned.
In her testimony, Anderson conveyed her belief that the original compensation was excessive and not reflective of the market conditions.
