Wellington Homeowner Faces Cost for 60-Year-Old Fence Issue
A homeowner in Wellington has been informed that he is responsible for the costs associated with replacing a fence that has encroached on public land for nearly 60 years. Adam Bush and his mother purchased the property in the Newlands suburb within the past few years, unaware that the fence on their front lawn extended beyond their boundary line.
Upon investigation, it was revealed that the Wellington City Council also lacked prior knowledge of the fence’s encroachment. In an email to Bush, the council stated that it had no records of the issue before December 10, 2023. This lack of awareness on both sides has led to a complex situation for the new homeowners.
The council recently removed the original fence to accommodate an electricity transformer being installed on the footpath. Following this action, Bush received notification that he must bear the financial responsibility for the fence’s replacement. Additionally, if the new fence extends beyond the property line, Bush was informed that he would need to pay for an annual encroachment licence.
Fortunately, the Wellington City Council has agreed to waive the encroachment licence fee for the new fence. Despite this concession, Bush remains concerned about the implications for future owners of the property. He fears that any subsequent homeowner could still be liable for costs associated with the encroaching fence.
This situation highlights the challenges that can arise from property boundaries, especially in older residential areas. Homeowners are often encouraged to verify property lines before undertaking any renovations or installations to avoid similar disputes.
As the issue unfolds, it raises questions about the responsibilities of homeowners and local councils in maintaining clear records of property boundaries and encroachments.
